Keith E. Toms

Keith Toms is an associate at Bromberg & Sunstein and an active member of the firm’s IP litigation, trademark, and copyright practice groups.  Keith has a broad range of experience litigating complex patent disputes across technologies ranging from biotechnology to sports equipment.  He is also experienced in trademark portfolio management and complex trademark litigation, with a particular focus on the prosecution and enforcement of trademarks in the pharmaceutical industry.

Experience

• Advised pharmaceutical industry clients on the Food and Drug Administration and the U.S. Patent and Trademark Office’s review of proprietary drug names.
• Developed global policing strategies for enforcing trademarks for industry leaders.
• Litigated trademark cases before the Trademark Trial and Appeal Board.
• Advised clients engaged in international trademark oppositions in jurisdictions including the European Union, Australia, Pakistan, Brazil, Indonesia, and South Africa among others.
• Litigated design patents covering innovative product packaging.
• Litigated theft of trade secrets cases involving medical technology and computer software.
• Advised clients on protecting and enforcing copyright.
• Assisted in the management of the United States and international trademark portfolios of a wide variety of industry leaders.
