Judith R.S. Stern
Judith R.S. Stern is special counsel at Bromberg & Sunstein. Practicing law since 1985, Judith concentrates on intellectual property matters, including trademark prosecution and licensing in the United States, Canada, the European Union, and numerous other countries; copyright prosecution and licensing in the United States; and litigation in federal courts. She focuses on practical approaches to creating global strategies for developing and enforcing trademark rights. Judith works closely with her clients from the initial stage of selecting a trademark and determining whether it is available for use, through prosecuting U.S. and foreign trademark applications, developing distribution and licensing agreements, and policing potentially infringing uses of marks.
Experience
- In trademark prosecution, she has represented clients involved in a wide range of goods and services, from computer technologies (including speech recognition and intelligent agent software), Internet-based services, and pharmaceuticals, to relatively "low-tech" products and services, such as educational services, retail store services, sports equipment, and clothing.
- Her clients range from start-ups with no previous experience in protecting their trademark rights to highly sophisticated clients with complex portfolios.
She has obtained copyright registrations for a range of works, from jewelry to computer software to websites.
- Judith has addressed a wide range of trademark issues before the United States Patent and Trademark Office, including likelihood of confusion, descriptiveness, and mutilation, and has an in-depth knowledge of the technical requirements of prosecuting trademark applications.
- In intellectual property litigation, she has addressed issues of trademark, copyright, and patent infringement. She brings her trademark and copyright litigation experience to bear on her prosecution and policing strategies.
Professional and Community Involvement
- Judith is a member of the Boston Bar Association, the Massachusetts Bar Association, the American Bar Association, and the Women's Bar Association of Massachusetts.
- She co-authored the publication "Protecting and Enforcing Copyright" (MCLE, Inc.).
- Judith wrote and co-authored articles on a variety of intellectual property topics, including obtaining Community Trademark protection using the Madrid Protocol, multiple-venue patent litigation, obtaining patent damages under provisional rights provisions, reducing risk of personal liability for patent infringement by relying on opinion of counsel, strategic opportunities for settlement in copyright litigation, and copyright duration.
- She has been a panelist with Massachusetts Continuing Legal Education, Inc.
- She has participated in the BBA/Citizens Schools Eighth Grade Academy tutoring program.
